Terms & Conditions

These Terms & Conditions ("Terms") apply to your use of instantbookingpro.com/ and to the InstantBookingPro service provided by Canvas ICT Pty Ltd (ABN 16 628 163 780) ("we", "us"). By using this website or signing up for our service, you agree to these Terms.

The service

InstantBookingPro is a done-for-you online booking service for service businesses. We build and host a branded booking page and admin dashboard based on the services, staff and availability information you provide. “Live in 24 hours” timeframes are typical targets, not guarantees, and depend on us receiving complete and accurate information from you.

Plans, billing and payment

All prices are in Australian dollars (AUD) and include GST. Current plans and prices are shown in the pricing section of our website and on the signup page before you pay.

Monthly billing. Monthly plans are charged in advance each month from the date you sign up and renew automatically each month until cancelled.

Annual billing. Annual plans are charged in advance for 12 months, in a single upfront payment, and renew automatically each year until cancelled. The annual price is 15% less than paying monthly for 12 months (the monthly price × 12 × 0.85).

Authorisation. By signing up you authorise us, through our payment provider Stripe, to charge your nominated payment method the amounts shown in your order summary and repeated in the signup confirmation: today’s payment (your first billing period plus any one-time charges) and each recurring subscription payment, at the billing frequency you selected, until your subscription is cancelled. Where your signup includes a promotional or individually agreed price, this authorisation covers that price for the period stated and, where stated, the amount that applies afterwards. We never see or store your full card details.

Special offers, promotional codes and individually agreed prices.

  • We may offer a promotional code or agree an individual price with you. The price, what it applies to, and how long it lasts are shown on the signup page and in Stripe’s checkout before you pay. That is the price you agree to.
  • Promotional prices apply only for the period shown (for example “first 3 monthly payments”). After that period, your subscription continues at the standard price for your plan and billing frequency that was shown when you signed up. That standard price is also subject to “Price changes” below.
  • Individually agreed prices are recorded against your subscription.
    • Ongoing agreed price: if your offer describes the agreed price as ongoing, it stays at that agreed amount for as long as you remain continuously subscribed to the same plan and billing frequency. We will not increase it under “Price changes” or otherwise.
    • Temporary agreed price: if your offer is temporary, it states before you accept it how long the agreed price applies and the exact price that applies afterwards. We will not charge a different amount during that period, and the price afterwards is the one stated in your offer.
    • If you change plan or billing frequency, or your subscription ends and you later subscribe again, the agreed price no longer applies and standard prices (or a new agreement) apply.
  • Only one promotional code or individual offer applies per signup; they cannot be combined. Codes and offer links have no cash value, may have an expiry date or a limited number of uses, may be limited to certain plans or billing frequencies, and may be withdrawn before use. Once a code or offer has been applied to a completed signup, we honour the terms shown at signup.
  • An individual offer link is for the person it was issued to, and may only be used with the email address it was prepared for.

Price changes. We may change our standard catalogue prices with at least 30 days’ notice by email. A change takes effect from your next renewal after the notice period, and never applies to a period you have already paid for. It does not apply to an ongoing individually agreed price, to a temporary agreed price or the price stated to follow it, or to a promotional price during its stated promotional period.

Failed payments and suspension.

  • If a payment fails, Stripe will automatically retry it, and we or Stripe will let you know by email.
  • If the payment is still unpaid after Stripe’s retries and our reasonable notices, we may suspend the service.
  • While your service is suspended, no further subscription fees accrue. You remain responsible for the amounts that were already outstanding when we suspended the service.
  • If you pay all outstanding amounts before your subscription is terminated, we restore the service.
  • If your account is still unpaid 30 days after we suspend the service, we may terminate (cancel) your subscription. We will tell you by email.
  • Your rights under “Intellectual property” to export your data apply on termination, as they do on cancellation.

Setup & Onboarding (included with every plan)

Every new subscription includes a one-time Setup & Onboarding charge, paid with your first payment. The introductory Setup & Onboarding price is $149 (incl. GST), shown against our standard setup value for your plan. We’ll configure your services, staff, business hours, branding and booking settings, then integrate Instant Booking Pro with your existing website. The Setup & Onboarding charge is one-time. It is not part of your recurring subscription and does not renew.

The introductory setup price is an offer that we may change or end for new signups at any time. It does not affect a price you have already paid.

New Business Website (optional add-on)

If you add a New Business Website during signup, we charge a one-time $249 (incl. GST) with your first payment. It is a small-business WordPress website based on an Instant Booking Pro standard design/template.

What’s included

  • Up to 5 standard pages.
  • A mobile-responsive WordPress website.
  • Your business and service information, which you supply to us.
  • A contact page and your contact details.
  • Integration with your Instant Booking Pro booking system.
  • Initial domain configuration where your requested domain name is available.
  • Up to two reasonable rounds of revisions.
  • 12 months of basic website hosting.

Delivery. We typically deliver your website within 10 business days after we receive all the content, information and access we reasonably need from you. This is an estimate, not a guaranteed deadline. If there are delays in receiving what we need from you, the timeframe is extended accordingly.

Hosting after the first 12 months. Hosting after the included 12-month period is optional and renewable separately. We will tell you the renewal price before the renewal, and you choose whether to renew.

Domain names. Any domain we register for you is subject to availability. We register it for you, or hold it for your benefit. If your requested domain name isn’t available, we’ll work with you to choose another.

What’s not included. Domain name registration and renewal fees are separate unless we expressly agree otherwise in writing. We’ll tell you about any separate charges and get your agreement before incurring them.

Custom development, e-commerce, complex integrations, extensive copywriting, professional photography and any other work outside this standard scope may need a separate quote. We’ll always quote before doing extra work.

Ownership. You own the content you supply and the completed website, subject to the licences of any third-party WordPress, theme, plugin or other software it uses. We keep ownership of our own templates, designs and systems, as set out in “Intellectual property”; you may keep using them as part of your completed website.

If you cancel Instant Booking Pro. Cancelling your Instant Booking Pro subscription does not take away your ownership or control of your website or domain. Included or paid hosting continues until the end of its included or paid period. After that, you can renew hosting with us, or arrange to move your website elsewhere, subject to reasonable technical migration requirements.

Your responsibilities

  • Provide accurate business, service, staff and availability information, and keep it up to date.
  • Use the service only for lawful purposes and genuine bookings.
  • Ensure you have the right to share any content (such as logos and images) you give us to use on your booking page.

Our responsibilities

We will provide the service with reasonable care and skill. We aim for high availability but, like any online service, we cannot promise the website or booking pages will be uninterrupted or error-free. Where issues occur, we will work to resolve them promptly.

Intellectual property

We retain ownership of the InstantBookingPro software, templates and systems. You retain ownership of your business content and customer data. On cancellation, you can request an export of your customer and booking data.

Cancellation

You can cancel at any time by contacting us. Cancellation stops your next renewal. It does not end the period you have already paid for.

  • Monthly plans: your service continues until the end of the month you have already paid for. Your subscription then ends and you won’t be charged again.
  • Annual plans: annual plans are paid upfront for the full 12-month subscription period. You can cancel at any time during that period, and cancelling stops the next annual renewal. You keep access to the service until the end of the 12-month period you have already paid for. At the end of that period your subscription ends and is not renewed. We do not give a full or pro-rata refund for the rest of an annual period just because you cancel or change your mind during it.

This section does not limit any rights or remedies you have under the Australian Consumer Law that cannot be excluded (see “Refunds”).

Your data export rights under “Intellectual property” apply on cancellation.

Refunds

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits those rights, including your right to a refund or other remedy where a service has a major failure.

Apart from those rights:

  • Subscription fees already paid for a billing period, including the full upfront fee for an annual plan, are not refunded in full or pro rata when you cancel or change your mind. You keep the service until the end of the period you paid for (see “Cancellation”).
  • Setup & Onboarding ($149): if you cancel for change of mind before we have started your onboarding/setup work, we refund the setup charge. Once that work has started, there is no change-of-mind refund of the setup charge.
  • New Business Website ($249): if you cancel for change of mind before we have started work on your website, we refund the website charge. Once website work has started, there is no change-of-mind refund of the website charge.

When work has started. Work has started when we begin substantive onboarding, configuration, integration, design, build or domain work for you. An initial acknowledgement or contact email does not, by itself, mean that work has started.

These points apply only to change-of-mind cancellations. They do not limit your rights and remedies under the Australian Consumer Law.

To ask for a refund, contact us at the email address on our website.

Tax invoices and receipts

We issue a tax invoice/receipt for every payment through Stripe, emailed to the billing email address and available from the link in your welcome email. It shows our business details and ABN, your business name, the plan, billing frequency, any one-time charges, the GST-inclusive amounts and the GST included.

Service availability, security and data

We take the security, availability and reliable operation of the service seriously, and we use reasonable security, availability and operational measures. However, no internet-connected system can be guaranteed to be uninterrupted, error-free or completely secure, and we do not guarantee that the service or your data will be.

The service relies on third-party providers, including hosting and cloud providers, telecommunications and internet networks, domain name (DNS) services, email services and our payment provider. Their availability is outside our control.

Liability

Your rights under Australian law. Nothing in these Terms excludes, restricts or modifies:

  • any consumer guarantee, right or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, restricted or modified; or
  • any liability that Australian law does not allow us to exclude or limit.

The rest of this section applies only to the extent permitted by law and subject to those rights.

Service interruptions, security incidents and events outside our control. To the maximum extent permitted by law, we are not liable for any loss or damage arising from or in connection with:

  • downtime or temporary unavailability of the service;
  • scheduled or emergency maintenance, or any other service interruption;
  • outages or failures of hosting, cloud, telecommunications, internet, DNS, email, payment-provider or other third-party services or platforms;
  • cyberattack, hacking or unauthorised access;
  • malware, ransomware or denial-of-service attack;
  • any other security incident;
  • loss, corruption, alteration or unauthorised disclosure of data; or
  • any other event outside our reasonable control.

Indirect and consequential loss. To the maximum extent permitted by law, we are not liable for any indirect or consequential loss. This includes:

  • lost profits or revenue;
  • lost bookings or lost business opportunities;
  • business interruption;
  • loss of reputation or goodwill;
  • loss of anticipated savings; and
  • any indirect or consequential loss arising from the loss, corruption or disclosure of data.

Limit on our liability. Where our liability can lawfully be limited but not excluded, and to the extent it is not excluded above, our total liability for any claim relating to the service is limited to the subscription fees you paid us for the service in the three months before the claim arose (for annual plans, one quarter of the annual fee), plus any one-time charges paid in that period.

Nothing in this section affects our obligations under the Privacy Act 1988 (Cth).

General

These Terms are governed by the laws of Australia. If any part of these Terms is found unenforceable, the rest continue to apply. We may update these Terms from time to time; the latest version will always be published on this page.
